1. Introduction and Acceptance

Welcome to Dashn.ai. These Terms of Service ("Terms") govern your access to and use of the Dashn.ai platform, an AI-powered platform that generates interactive, self-explaining dashboards from spreadsheet data, provided as a web application.

By accessing or using Dashn.ai, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to any provision of these Terms, you must not use the platform.

Dashn.ai is operated by a company incorporated in Brazil. For users located outside of Brazil, these Terms are governed by the laws specified in Section 14 below.

2. Definitions

  • "Dashn.ai" or "Platform": the software-as-a-service (SaaS) application that is an AI-powered platform that generates interactive, self-explaining dashboards from spreadsheet data.
  • "User" or "You": any individual who accesses or uses the Platform.
  • "Account": the individual registration created by the User on the Platform.
  • "User Content": any data, text, files, or information submitted by the User to the Platform, including file uploads and text inputs.
  • "AI Services": the artificial intelligence features provided by the Platform, processed through third-party large language model (LLM) APIs via the OpenRouter service.
  • "Subscription": the paid plan contracted by the User (monthly or annual billing cycle).

3. Description of Service

Dashn.ai is a data analysis tool that uses artificial intelligence to generate interactive dashboards from spreadsheets (CSV, XLSX) and Google Sheets data. The Platform automatically analyzes uploaded data, identifies relevant metrics, and creates self-explaining visualizations that can be edited using natural language.

The Platform enables file uploads (CSV, XLSX), Google Sheets connections, and natural language interaction. User-submitted data is processed by third-party large language models (LLMs) accessed through the OpenRouter service to generate AI-generated dashboards and insights.

Important: AI-generated dashboards and insights are assistive in nature and do not replace professional judgment. Dashn.ai is not responsible for decisions made based on AI-generated content.

4. Account Registration

4.1. Creating an Account

To use the Platform, you must create an Account by providing:

  • Full name
  • Email address
  • Professional information (company, company size, and role), provided through an optional questionnaire

4.2. Account Responsibility

You are responsible for the accuracy of your registration information and the security of your login credentials. All activity conducted through your Account is your responsibility.

4.3. Age Restriction

Dashn.ai is intended exclusively for individuals aged 18 or older. By creating an Account, you represent that you are at least 18 years of age.

5. Plans and Payment

5.1. Free Plan

Dashn.ai offers a free plan with limited features. The scope of the free plan may be modified at any time upon reasonable notice to Users.

5.2. Paid Plan

The paid plan offers expanded features and is available through monthly or annual subscriptions. You may choose your preferred billing cycle at the time of purchase.

5.3. Billing and Renewal

Subscriptions renew automatically at the end of each billing cycle (monthly or annual) unless cancelled before the end of the current period. You will be charged using the payment method on file.

5.4. Cancellation

You may cancel your subscription at any time through the Platform. Cancellation takes effect at the end of the current paid period, with no penalty or additional charges.

5.5. Refunds

Refund requests may be submitted within 14 (fourteen) days of the initial purchase date. Refunds apply to first-time purchases only and are not available for subscription renewals.

Refunds may be denied if the Account has consumed significant Platform resources (e.g., multiple dashboards created or data processed). Refunds are processed on a case-by-case basis and are not guaranteed, except where required by applicable law.

5.6. Price Changes

Dashn.ai reserves the right to modify subscription pricing upon at least 30 (thirty) days' prior notice. Price changes will not affect the current billing cycle.

6. Acceptable Use

You agree to use the Platform in an ethical manner and in compliance with all applicable laws. The following are expressly prohibited:

  • Using the Platform for unlawful, fraudulent, or rights-infringing purposes
  • Submitting content containing viruses, malware, or malicious code
  • Attempting to access restricted areas of the Platform, its servers, or security systems
  • Reverse engineering, decompiling, or disassembling any part of the Platform
  • Using the Platform to generate content that infringes third-party intellectual property rights
  • Sharing Account credentials with third parties or allowing unauthorized use of your Account
  • Submitting sensitive personal data of third parties without a valid legal basis

Violation of any of these conditions may result in suspension or termination of your Account, without prejudice to any other legal remedies available.

7. Intellectual Property

7.1. Platform Ownership

All intellectual property rights in the Platform, including software, design, logos, text, trademarks, and other elements, are the exclusive property of Dashn.ai or its licensors. Nothing in these Terms grants you any ownership rights in the Platform.

7.2. User Content

You retain ownership of User Content submitted to the Platform. By using the Platform, you grant Dashn.ai a limited, non-exclusive, revocable license to process, store, and transmit your User Content solely for the purpose of providing the Services.

7.3. AI-Generated Content

Content generated by the AI in response to your interactions is provided as an assistive tool. You may use AI-generated content for your professional purposes, assuming full responsibility for its use.

8. Use of Artificial Intelligence and Third-Party Services

Dashn.ai uses third-party large language models (LLMs) accessed through the OpenRouter service for data processing and generation of AI-generated dashboards and insights. You acknowledge and agree that:

  • Data submitted to the Platform (spreadsheets and files) may be transmitted to third-party AI providers for processing
  • Dashn.ai takes reasonable measures to protect transmitted data but does not have full control over processing performed by third-party AI providers
  • AI-generated dashboards and insights may contain inaccuracies, errors, or outdated information and should not be used as the sole basis for critical decisions
  • The availability and performance of AI services depend on their respective third-party providers and may be subject to interruptions

9. Data Storage

Platform data, including registration data and User Content, is stored using the Supabase service. Dashn.ai implements appropriate technical and organizational measures to protect the security and integrity of stored data, including encryption in transit and at rest.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • Dashn.ai does not guarantee that the Platform will be available without interruption or free of errors
  • Dashn.ai shall not be liable for indirect, incidental, consequential, or punitive damages arising from the use of the Platform
  • Dashn.ai's total liability, under any circumstances, shall be limited to the amounts actually paid by the User in the 12 (twelve) months preceding the event giving rise to the claim
  • Dashn.ai is not responsible for actions, decisions, or outcomes based on AI-generated content

Note: These limitations do not apply where prohibited by applicable law.

11. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." EXCEPT WHERE EXPRESSLY PROHIBITED BY APPLICABLE LAW, DASHN.AI MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Suspension and Termination

12.1. By the User

You may close your Account at any time through the Platform settings. After account closure, your data will be handled as described in the Privacy Policy.

12.2. By Dashn.ai

Dashn.ai may suspend or terminate your Account in the following circumstances:

  • Violation of these Terms of Service
  • Use of the Platform for unlawful purposes or in violation of applicable law
  • Non-payment of the paid plan
  • Prolonged Account inactivity, upon prior notice

In the event of termination due to a violation of these Terms, Dashn.ai is not obligated to refund any amounts paid.

13. Modifications to the Terms

Dashn.ai reserves the right to modify these Terms at any time. Material changes will be communicated to Users at least 30 (thirty) days in advance via notification on the Platform or by email.

Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you may close your Account without penalty.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict of law principles.

Any disputes arising from these Terms shall first be submitted to good-faith negotiation. If unresolved within 30 (thirty) days, disputes shall be submitted to the courts of São Paulo, Brazil.

15. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Dashn.ai.
  • Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • Assignment: You may not assign or transfer your rights or obligations under these Terms without Dashn.ai's prior written consent.
  • Waiver: Dashn.ai's failure to enforce any provision of these Terms shall not constitute a waiver of its right to enforce such provision.
